What you are talking about is known in the investing and real estate world as buying a "subject to the existing This is a deal that if I have the money and the situation is right, going to do this deal all day long. I am not going to do it in an area where there are a ton of for sale and values are sinking. In exchange for cash to either catch up payments, help the owner to move, or whatever I will get title to the by way of warranty deed, quit-claim, etc. At that point the responsibility for the payments is mine, but the option to refinance the I now own, is also mine. Is the former lender going to call the loan due? They could, but if their money is coming in every month, do you think it matters? Do you know any lenders that are going to spend thousands of dollars to foreclose on a loan that is performing? Do you think there are any children out there that have said to their " Mom, I know things are tough for you now, deed the to me, cover all the payments and you can live here as long as you live."

Definitely consult with an attorney. If you get it correct to within $200 or so, that should be good enough. And they mind if you overpay, and ask for a refund later. No, it is not what going to end up paying. It is the TOTAL tax liability, which includes what you have been paying (payroll withholding) during the year, plus what you might end up paying later. (or minus any refund.)

It's an estimate, not the final numbers. If you get it correct to within $200 or so, that should be good enough. They applied to your principle unless you made a notation. Otherwise it goes in the escrow account, you have to specify that for the principle to lower the actual amount due. Read all your statements since overpaying, there see where the extra $$ was applied to.

Hi,<br

The only notes that are assumable are FHA notes and you must qualify to do so. The owners must retain these in their names or it triggers the due on sale clause in the deed of trust and once you have it caught up the seller can take possession of the home again. Now some may be legit but trust no one in this with out an atty representing you

So that you have the receipts showing that you were the one making those payments. I have had people here ask what do they do after having been making payments to the owner who apparently, never paid the bank. They trusted and while my first inclination is also to trust, it is NOT prudent to do so when you have the most to lose. If they make the payments then they have anything to lose! In effect if they make the payments, the bank is the new owner so even if they have "equity" it giving them any benefit, is it? It can be easy but, be cautious. If I were to set this up I would want the buyer to prove they have paid the lender to the Seller (or get out of the I would probably as the seller ask them for at least 3 months of "rent" so that I had time to get someone else in the if the "buyer" defaulted or pay. As a buyer I would expect to make payments for at least a year before I went to the Lender and asked that the loan be transferred into my name with perhaps a lower interest rate? At that time they will have proof that you have paid and paid on time for over a year and that you are reliable and so they should consider this arrangement with you. See? Good luck.

If you ever knew anyone who decided that they wanted to do this-be that you read everything closely and choose to make those payments DIRECTLY TO THE LENDER! This is usually a good deal for you because most cars depreciate so fast that they are less than what you owe on them for most of the time you are paying (this is known as down'). If he wants to leave the loan in your name and just pay you or something like that this is probably not good for you.

Well, sometimes it just means that he is willing to pay what you owe, but no more. I believe there are many lenders that would allow you to just come in and take over payments without some hefty cash down and PERFECT credit, and cash flow. So say this is some kind of scam.

Christine, the chances are you would have to come up with alot of cash to do this. You do not need to know the amount. There are very few today that are assumable by a buyer. Even if it is assumable, you would still have to be approved by the lender as if you were applying for a new loan. Some people will attempt to sell their home and have the buyer "take over" the payments. In most cases, this is in violation of the agreement--most loans have a "due on sale" clause that would require the loan be paid off. If the lender finds out, it could declare the loan in default and accelerate the payments. If the loan paid off, then the lender would foreclose. You could do one of these deals but be aware you are in violation of the loan. However, if you later default, its not on your credit--it is still the credit of the original borrower.Be very careful if you try to do one of these deals.

The majority of those ads are at best misleading and at worst outright scams. If your father makes the payments, the other guy gets to keep the truck. The only way it works is if your father buys the truck from this "guy that your father knows" and the guy pays off his debt.

Sounds like a scam to me as loans in the US are not transferable. Not gonna happen. You need to get a new loan, or just draw up a document completely outlining the deal. Then you make payments to him. You need to express any extra interest payments, how things will be handled if you are late paying him, what happens if you pay him for X number of months, how the transfer of the title will happen, and what happens to YOUR money if HE stops making payments. Risky deal so be careful.

No vehicle loan is assumable. Not gonna happen. Throwing 18 trillion dollars at social programs of which many of these dollars were to those that are less (aka as being too far on the left side of the Bell Curve) has changed life course for but few. This should surprise no one.It is time to no longer these people and instead requie that they use what wits they have to survive in our society. Sure, some will gravitate to crime while others do not. This must be done soon before they double their present number as they did during the past 35 years. They lived lazily and sometimes even lavishly during the past 45 year age of society programs. No longer can the nation afford such largesse nor should it ever have implemented such programs in the first place.Social programs directed to poor' since 1965 have cost our nation many trillions of dollars. To date this exceeds the current National Debt. If these social programs are not soon stopped the result may well be economic calamity for the nation. That day is soon to arrive if measures to significantly reduce social spending are not implemented.. and be made permanent. Once eliminated, they are never to return. Those disagreeing can move to another nation or continent where they can fashion the type society they want and do so dolely at their risk and expense.

LOOK.. some things simply cannot be fixed. Writing hardship letters does not have to be difficult, but you need to know what your lender is looking for. Many homeowners simply do not understand the basics of writing an effective hardship letter and this is costing them their homes. When i was in that situation two year ago, i acquainted with a free mini course that shows me how to responsibly state my income so that my debt to income ratio is the target my lenders are looking for. I have seen this too much and have decided to put an end to the thousands of people who just need to follow a hardship letter sample and simply written up to date guidelines.

“Thousands of Americans are losing their homes because of mistakes in their Hardship Letters; Don’t let your family be one of them!”

Write a hardship letter to your lender, explaining your present situation. In addition, they want to know if you have made any payments in 2008, estimated tax payments. Also, you would have to give a little more info than what you have given. Is this for personal taxes, or a business????????If it is personal taxes just go online and e-file before April 15, 2009 and you need an extension. If it is for business and you have a financial statement just take the bottom line, net profit/net loss and multiply that by 28% for federal and 5% for state and use that as the estimated tax due, until you get your taxes completed.

They want you to estimate how much money you think you will owe the IRS once the taxes are completed. Folks in trouble are looking to avoid foreclosure by simply issuing you a quit claim deed to gain title to the house, and then allowing you to continue making THEIR payments. The problem is that taking over someone thusly is not allowed by the lender without approval and refinance. But since you are a good customer, you may be able to have a few payments forgiven, to ask.

No. Any overage you pay is applied to your balance, the lender does not apply this to your future balance.
